Woman suing Broadway at the Beach after being hit with fireworks, lawsuit says


MYRTLE BEACH, SC (WMBF) – A woman who claims she was struck in the head during a fireworks display at Broadway at the Beach on July 21, 2015 has filed a lawsuit against the entertainment and shopping complex.

Kelly Deffner is suing Burroughs and Chapin, Broadway at the Beach, Broadway at the Beach Owners Association, Pyrotecnico Fireworks and S. Vitale Pyrotechnic Industries.

According to the lawsuit, which was filed in Hilton Head Island on Monday, Deffner was hit by a firework while standing with her husband on a portion of decking at Broadway. After being hit, she fell to the ground and suffered injuries, the suit says. The filing does not mention the extent of her injuries.

Amongst other claims, Deffner says the defendants failed to maintain a reasonably safe premises for invitees, failed to warn of a known dangerous condition and failed to properly oversee the discharge of fireworks.

Deffner is seeking an unspecified amount of damages.
